Skilled Worker Class
Permanent residence for skilled workers. The point system and related issues. Employer sponsorship is not a requirement (Who qualifies?)
The federal skilled worker class is point based and confers permanent resident status to applicants who are able to demonstrate an ability to become economically established in Canada. Applicants are assessed under these following factors:
- Education
- Language
- Experience
- Age
- Arranged employment
- Adaptability
and numerous sub factors of assessment providing for 100 points. Individuals with at least one year of continuous full-time employment experience or the equivalent in part-time employment in one or more “open” occupations, within the 10 years preceding the date of their application and who possess the required settlement funding, may qualify for assessment.
Applicants who do not meet the applicable pass mark may be accepted under the positive discretion provisions of the regulations. This mechanism is used to accept a number of applicants who will be able to successfully settle in Canada yet who do not meet the applicable pass mark. Family Class Sponsorship
Canadian citizens and permanent residents living in Canada, 18 years of age or older, may sponsor close relatives or family members, including spouses, common-law/same-sex partners, conjugal partners who cannot live together and dependant children applying outside of Canada who wants to become permanent residents of Canada. Sponsors must promise to support the relative family member and their accompanying family members for a period of 3 to 10 years to help them settle in Canada.
The following are general guidelines for family class sponsorship:
- Sponsoring your spouse
- Sponsoring parents and grandparent
- Sponsoring children or adopted children
- Sponsoring other relatives
But, if none of the above applies, and you are alone in Canada, you are allowed to sponsor a sole remaining family member living outside Canada.

Economic Class (Business and Investment Class)
There are three programs offering permanent residence for persons with successful managerial experience and varying thresholds of personal net worth.
INVESTOR CLASS
In order to qualify in the category of a successful Investor Class, the applicant must satisfy the following criterion beforehand:
1) Managed a qualifying business and has controlled a percentage of equity of the qualifying business for at least two years in the period beginning five years preceding the application (the ownership option) or managed at least five full-time employees per year for at least two years in the period beginning years preceding the application (the management option) and;
2) Possesses a personal net worth of C$800,000 legally obtained and:
3) Invests C$400,000 in a government approved investment fund.
ENTREPRENEUR CLASS
In order to qualify in the category of a successful Investor Class, the applicant must satisfy the following criterion beforehand:
1) Managed a qualifying business and has controlled percentage of equity of the qualifying business for at least two years in the period beginning five years preceding the application and;
2) Possesses a personal net worth C$300,000 legally obtained (assets may comprise of inheritances as well as the assets of a spouse/common-law partner/same sex partner) and;
3) Undertake control at least 33% of the equity of a Canadian qualifying business and provide active and ongoing management of the qualifying Canadian business that create at least one incremental full-time job (37.5 hours per week or more) for Canadian citizens or permanent residents, other than the entrepreneur and their family members. This condition must be fulfilled for a period of one year of one year within the period of three years after the day on which the entrepreneur becomes a permanent resident. This is known in the industry as meeting entrepreneurial terms and conditions.
SELF-EMPLOYED CLASS
Self-employed persons must have the intention and ability to create their own employment. They are expected to contribute to the cultural or athletic life of Canada. They may create their own employment by purchasing and managing a farm in Canada, for example.

THE CANADIAN REFUGEE SYSTEM
Refugee Protection
Refugees and persons needing protection are people in or outside Canada who fear returning to their country of nationality or habitual residence. In keeping with its humanitarian tradition and international obligations, Canada provides protection to thousands of people every year.
Through its refugee protection system, Canada offers safe haven to persons with a well-founded fear of persecution, as well as those at risk of torture or cruel and unusual treatment or punishment. Canada’s refugee protection system consists of two main components:
1) The refugee and Humanitarian Resettlement Program, for people seeking protection from outside Canada and
2) The In-Canada Refugee Protection Process, for persons making refugee protection claims from within Canada.
Canada has signed the United Nations 1951 Geneva Convention relating to the Status of Refugees and its 1967 Protocol. This Convention protects refugees from being returned to a country where they would face persecution.

The Personal Information
One of the most important issues that arise in a refugee claim is establishing that a refugee claimant is credible. Provincial Nominee Program (PNP)
Qualified employers nominate a prospective worker under an expedited process, which, once approved by the province, enables an application for permanent residence to proceed under a processing stream that completely bypasses the lengthy federal immigration process. In many instances, applicants can conclude these formalities without ever having to actually return to their former place of habitual residence.
